EveryFave Incorporated ("EveryFave", "we", "us", or "our") respects your privacy and is committed to protecting it. This Privacy Policy (this "Policy") describes the types of information we may collect from or about you when you visit the EveryFave Platform, available via desktop or mobile browser at www.everyfave.com (the "Platform"); use the associated services available on the Platform, including, but not limited to, business marketing and promotion, online browsing, and interactive services (collectively, the "Services"); or otherwise when communicating with us; as well as our practices for collecting, using, storing, disclosing, and retaining that information.
BY USING OUR PLATFORM OR SERVICES, YOU CONSENT TO THE COLLECTION, USE, STORAGE, DISCLOSURE, AND RETENTION OF YOUR PERSONAL INFORMATION BY US IN ACCORDANCE WITH THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, YOU SHOULD NOT ACCESS OR USE OUR PLATFORM OR SERVICES.

The purpose of this Policy is to inform you of EveryFave’s privacy practices and policies, including:

This Policy is designed to comply with applicable federal and provincial privacy legislation in Canada, including, when applicable, the Personal Information Protection and Electronic Documents Act ("PIPEDA"). You should read this Policy carefully. This Policy is incorporated into, forms part of, and is subject to our Terms and Conditions of Use.
- What is Personal Information?
In this Policy, "personal information" means information about an identifiable individual, as further defined under applicable Canadian privacy laws.
- Consent for the Collection, Use, and Disclosure of Your Personal Information
Please read this Policy carefully. If you do not understand or agree with our practices as described in this Policy, please contact us as set out below in Section 20 (Contact Us), so we may, to the extent possible, specifically address your privacy concerns.
By accessing or using our Platform or Services, you agree to the terms of this Policy. This Policy may change from time to time (see Section 19 (Changes to Our Privacy Policy), below). Your continued use of our Platform or Services after we make changes to this Policy constitutes acceptance of those changes, so please check this Policy periodically for updates. We will notify you by email or by posting a notice on the Platform’s home page in the event of a material change to this Policy.
When you provide us with your personal information through the Platform, Services, or in communicating with us, you consent to the collection, use, and disclosure of such information in accordance with this Policy or for the purposes identified to you at the time you provided your personal information.
- Where Does this Privacy Policy Apply?
This Policy applies to information we collect on our Platform; from your use of our Services; and in e-mail, text, and other communications between you and us.
This Policy does not apply to information collected by any third party or through any application or content that may link to, be accessible from, or on, or through our Platform or Services. We do not operate or control any information, software, products, or services available on such third-party websites. The inclusion of a link to a website does not imply our endorsement of the service or the site, its contents, or its sponsoring organization. You should carefully read the privacy statements of every site that collects personally identifiable information.
In addition, Anonymized Aggregated Information (as defined below in Section 9 (How Do We Use Your Information?)) is not subject to this Policy.
- What Kinds of Information Do We Collect?
The information we collect from you depends on how you use our Platform and Services. We will only collect personal information that is reasonably necessary for the purpose of providing our Services to you. You should exercise discretion when disclosing your personal information to us and should not disclose sensitive or confidential information that you wish to remain private.
We may collect, use, store, and transfer different kinds of information about you, which we have grouped together as follows:
Registration and contact information when you create an account to use our Services, such as first and last name, e-mail address, phone number, password, date of birth;
Business information, if you are a Business as defined in our Terms and Conditions of Use, such as business name, business phone number, business address, business type, and business description;
Optional information that you may choose to provide to us in your account settings to customize your Platform experience, such as your gender, location, and content preferences;
Communication information such as conversation records when you e-mail or otherwise communicate with us;
Submitted Content, as defined in our Terms and Conditions of Use, such as any photos, videos, descriptions, notes, comments, information, concepts or other material that you may submit, upload, or post to our Platform; and
Usage data such as metadata, performance metrics, usage trends or volume, and information about your interactions with our Platform or Services.

- How Do We Collect Your Information?
We may collect information on or through our Platform and Services in the following ways:
directly from you when you provide it to us, including by registering for our Platform or Services, filling in forms or answering surveys on the Platform, at the time of subscribing to receive information from us, and when you contact us directly;
from third parties in connection with providing our Services to you. Additionally, we may receive content, communications, and information that other users provide when they use the Platform or Services. This can include information about you, such as when others provide Submitted Content to the Platform; and
from automated data collection technologies including cookies, tags, web beacons, pixels, and other technologies as defined further in Section 7 (What Automatic Data Collection Technologies Do We Use?) below.
- What Automatic Data Collection Technologies Do We Use?
As you navigate through and interact with our Platform or Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and patterns, including:
Details of your visits to our Platform and use of our Services, including traffic data, location data, logs, and other communication data and the resources that you access and use on our Platform; and
Information about your device and internet connection, including your IP address, operating system, and browser type.
The information we collect automatically is only statistical data and does not include personal information, but we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Platform and Services and to deliver a better or more personalized service, including by enabling us to:

Cookies (or browser cookies): A cookie is a small text file sent from a website and stored on the user’s computer by the user’s web browser. You may refuse to accept browser cookies by activating the appropriate setting on your browser. Web Beacons: Pages of our Platform and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an e-mail and for other related statistics (e.g., recording the popularity of certain content and verifying system and server integrity).
Log and Usage Data: Information is automatically collected about website performance, server performance, page usage, contact form submissions, system activity, error records, IP addresses, hardware settings, browser types, Internet service provider, date/time stamps, and other information that may help us build a better user experience.

Cookies Set by Third Party Sites
To enhance our content and to deliver a better online experience for our users, we sometimes embed images and videos from other websites on our Platform. We currently use, and may in the future use, content from websites such as Facebook, LinkedIn and X (formally known as Twitter). You may be presented with cookies from these third party websites. Please note that we do not control these cookies. The privacy practices of these third parties will be governed by the third parties’ own privacy statements or policies. We are not responsible for the security or privacy of any information collected by these third parties, using cookies or other means. We also use Google, a third party analytics provider, to collect information about Platform and Services usage and visitor information. Google uses cookies in order to collect demographic and interest-level information and usage information from users that visit our Platform and/or use our Services, including information about the pages where users enter and exit the Platform and what pages users view on the Platform, time spent, browser, operating system, and IP address. Cookies allow Google to recognize a user when a user visits the Platform and when the user visits other websites. Google uses the information it collects from the Platform and/or Services and other websites to share with us and other website operators’ information about users including age range, gender, geographic regions, general interests, and details about devices used to visit websites and purchase items. We do not link information we receive from Google with any of your personally identifiable information. - How Do We Use Your Information?
We use information that we collect about you or that you provide to us, including any personal information, for the following purposes:
To register you on our Platform for our Services and to authenticate users for security purposes;
To provide our Services;
To provide, maintain, evaluate, and improve our Platform and Services and any other products or services of ours;
To provide you with information that you request from us, including customer support;
To verify your identity and confirm the accuracy of your information;
To operate and administer our Platform, respond to problems, and detect and respond to possible fraud, abuse, and security risks;
To carry out our obligations and enforce our rights arising from any contracts entered into between you and us;
To notify you about changes to our Platform or Services, or any other products or services we offer or provide though it;
To send you marketing and promotional information, provided you have opted to receive such communications;
As permitted by, and to comply with, applicable laws and regulations;
In any other way we may describe when you provide the information; and

We may use aggregated information about our users, and information that does not identify any individual, without restriction ("Anonymized Aggregated Information"). Information is deemed "anonymized" when it is, at all times, reasonable to expect in the circumstances that it irreversibly no longer allows the person to be identified, directly or indirectly. By using our Platform or Services, you agree to allow us to anonymize your information where appropriate for us to do so.
- How Do We Disclose Your Information to Other Parties?
We may disclose your personal information:
To fulfill the purpose for which you provide it;
To Businesses (as defined in our Terms and Conditions of Use) in relation to interactions through our Platform or Services, and customer support;
When contracting with External Third Parties (as defined below) who help us provide, maintain, and/or improve our Platform and/or Services. We may contract with External Third Parties to help us manage, monitor, and/or optimize our Platform or Services, or to market our products and services. To the extent that any personal information is provided to these External Third Parties, we require that they be bound by obligations consistent with this Policy and that they only collect, use, or disclose your personal information for the purpose of providing such services to us. External Third Parties that have access to your personal information will be subject to legally enforceable obligations that will prohibit them from using or disclosing your personal information except for the purpose of providing services to us, to comply with applicable law, or consistent with privacy-specific laws such as Canada’s PIPEDA;
To a buyer or other successor in the event of an acquisition, merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of EveryFave’ assets or equity, in which your personal information is among the assets transferred;
For any other purpose disclosed by us when you provide the information; and
With your consent.
We may also disclose your personal information:
To comply with any court order, law, or legal process, including to respond to any government or regulatory request;
To enforce or apply our Terms and Conditions of Use and/or other agreements;
If we believe disclosure is necessary or appropriate to protect our rights, property, or safety of our customers or others; and
To a government institution or part of a government institution that has made a request for the information, identified its lawful authority to obtain the information, and indicated that the disclosure is requested for the purpose of enforcing any law of Canada, a province, or a foreign jurisdiction, carrying out an investigation relating to the enforcement of any such law, or gathering intelligence for the purpose of enforcing any such law.
For the purpose of this Policy, "External Third Parties" refer to the following categories of organizations that we may share information with:
Service providers that we engage to perform services on our behalf, including information technology and platform administration service providers (such as Amazon Web Services). Additional third-party service providers include email marketing service providers, payment service providers, information security service providers, and automated content verification service providers;
Professional advisers acting as processors or joint controllers including lawyers, bankers, auditors, and insurers who provide consultancy, banking, legal, insurance, and accounting services; and
Government bodies or law enforcement agencies, when we believe it to be necessary for compliance with the law or to protect our users, Platform, Services, or the public.
We may disclose Anonymized Aggregated Information about our users, and information that does not identify any individual, without restriction.
- Your Choices About How We Use and Disclose Your Information
We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with control over your information, such as:
Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of our Platform or Services may then be inaccessible or not function properly;
Promotional Offers. You will only receive promotional or marketing e-mails and/or text messages from us if you opt-in to our marketing mailing list. You may unsubscribe from this list at any time using the methods outlined below in Section 13 (Marketing Preferences); and
Targeted Advertising. - Your Privacy Rights
You have the right to request details about the personal information we hold about you. You may request from us information about:
the personal information we hold about you;
the categories of personal information concerned;
the purposes of the processing;
details to whom your personal information has been/will be disclosed;
how long we retain your personal information;
if we did not collect the information directly from you, information about the source; and
how to lodge a complaint with the correct supervisory authority.
You may also request that we:
update any incomplete or inaccurate information about you; and
delete your personal information in accordance with applicable laws.

Before responding to your request, we may ask for proof of identity and sufficient information about your interaction with us so that we can locate any relevant data. There may be circumstances where we are unable to provide access to your personal information. We may deny access for legally permissible reasons, such as situations where the information contains references to other users and is not reasonably severable, or where it cannot be disclosed for legal, security, or commercial proprietary reasons, or information that is subject to solicitor-client or litigation privilege. We will advise you of any reason for denying an access request.
We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
- Marketing Preferences
If you have provided us with your contact information, we may, subject to any applicable anti-spam laws or regulations, contact you via e-mail, postal mail, text message, or telephone about our products, services, and/or events that may be of interest to you.
We will only send you marketing messages if you provide your consent to receive them. You may unsubscribe at any time using the methods outlined below. All marketing messages will comply with applicable anti-spam legislation.
You can update and manage your marketing preferences through the profile settings in your user account. In addition, e-mail communications you receive from us will generally provide an unsubscribe link allowing you to opt-out of receiving future e-mails or to change your contact preferences. E-mail communications may also include a link to directly update and manage your marketing preferences. Please remember that even if you opt out of receiving marketing e-mails, we may still send you important information related to your accounts and subscriptions.
- How to Opt-out or Withdraw Consent to the Use of Your Personal Information?
You may withdraw your consent to the collection, storage, use, disclosure, and retention of your personal information at any time, subject to legal and contractual restrictions and reasonable notice. Withdrawal of your consent to the collection, storage, use, disclosure, and retention of personal information may result in you being unable to continue use of our Platform and Services.
- How Do We Keep Your Information Secure?
We have implemented industry-standard security measures to protect your personal information. We employ physical, technical, and organizational safeguards appropriate to the sensitivity of the data to protect the personal information you provide to us from loss, theft, unauthorized disclosure, copying, and unauthorized use or modification. However, with the internet and technology constantly changing and evolving, there is no way to guarantee that your information will be 100% safe. Further, no method of transmission over the internet or electronic storage is completely secure, and therefore we cannot ensure, warrant, or guarantee the security of any such personal information.
By using our Platform or Services, you agree that you are using the Platform or Services and transmitting personal information at your own risk. You should only access our Platform and Services within a secure environment to limit threats. We are not responsible for circumvention of any privacy settings or security measures contained on the Platform or Services.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to parts of our Platform or Services, you are responsible for keeping this password confidential. You may not share your password or other user account information with anyone.
We shall comply with, and provide you with, reasonable assistance in complying with applicable laws with respect to any unauthorized use, access, or disclosure of your personal information.
If you think the personal information you provided to us has been improperly accessed, used, or disclosed, or if you suspect that there has been unauthorized use of your personal information, please contact us immediately as set out in Section 20 (Contact Us) below.
- How Long Do We Keep Your Personal Information?
We retain personal information for only as long as necessary to provide the Services, fulfill the purpose for which your information was collected, or for other business purposes, including but not limited to complying with our legal obligations, resolving disputes, and enforcing our agreements. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. We are required by law to keep some types of information for certain periods of time (e.g., statute of limitations).

- Where is Your Personal Information Stored and Processed?
We currently store and process your personal information and other content you provide to us on servers located in Canada. Our servers follow industry standards pertaining to security. In some circumstances, your personal information may be stored, processed, shared, or otherwise used on servers belonging to External Third Parties located outside Canada, such as the United States. Such External Third Parties are only permitted to store, process, and access your personal information, and are not otherwise authorized to collect, use or disclose your personal information, except in accordance with the purposes set out in this Policy or as required by applicable law. However, it is possible that foreign governments, courts, law enforcement, or regulatory agencies may be able to access your personal information under foreign laws when shared with External Third Parties.
By using our Platform or Services, or otherwise providing us with personal information, you agree to the transferring of your personal information in accordance with this Policy and applicable data protection laws and regulations.
- We Do Not Knowingly Collect Personal Information from Children
Our Platform and Services are not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13 through the Platform, Services, or by other means.
No one under 13 should share any personal information with us through the Platform or otherwise. IF YOU ARE UNDER 13, WE ASK THAT YOU NOT PROVIDE ANY INFORMATION TO US ON OUR PLATFORM OR THROUGH ANY OF ITS FEATURES.
If we learn we have collected or received personal information from a child under 13, without verification of parental consent, we will delete that information from our records in accordance with applicable laws. If you believe we may have any information about a child under 13, please contact us using the information provided below in Section 20 (Contact Us).
- Changes to Our Privacy Policy
We will post any changes we make to our Policy on this page, with a notice that this Policy has been updated on the Platform homepage. If we make material changes to how we treat your personal information, we will notify you by e-mail specified in your account (if any) or through a notice on the Platform homepage. The date this Policy was last revised is identified at the top of this page. If you are a registered User of our Platform (as defined in our Terms and Conditions of Use), you are responsible for ensuring that we have an up-to-date, active, and deliverable e-mail address for you. Otherwise, you are responsible for periodically visiting our Platform and this Policy to check for any changes. Your continued use of the Platform or Services after we make changes constitutes acceptance of those changes.
